The State Council issued the Regulations on the Examination of Fair Competition, which stipulates that the policy measures drafted by the drafting unit shall not contain restrictions or disguised restrictions on market access and exit. Illegal approval procedures shall not be set up for industries, fields, businesses, etc. beyond the negative list for market access; illegal setting or granting of franchise rights; limited operation, purchase or use of goods or services provided by specific operators; unreasonable or discriminatory access and exit conditions shall not be set up. The regulation will come into effect from August.

The regulations stipulate the content that restricts the free flow of goods and factors, which affects production and operation costs. The regulations require limiting the entry of goods or factors from other places or imports into the local market, or obstructing local operators from moving out, exporting goods and factors; excluding, restricting, forcing, or coercing other operators outside the city to invest and set up branches in the city, and participate in local government procurement, bidding and tendering; setting discriminatory charging items, charging standards, prices or subsidies for goods or factors from other places or imports. In addition, there is no legal or administrative basis or approval by the State Council, specific operators shall not be given tax incentives, selective differentiated financial rewards or subsidies, etc.

To open up the domestic circulation, the mainland is accelerating the construction of a unified national market, trying to break through local protection and market segmentation, unblock the key obstacles that restrict the economic cycle, and promote the smooth flow of commodity and factor resources within a larger scope. The regulation also requires that in conducting fair competition review, opinions on the impact of fair competition from relevant operators, industry associations and chambers of commerce should be heard; for matters involving public interests, public opinions should be heard.
