Vale SA has provided an update on the ongoing settlement negotiations concerning the Samarco Fundão dam collapse. The company, along with Samarco Mineração S.A., BHP Billiton Brasil Ltda., and various Brazilian government entities, are discussing terms for a Definitive Settlement. The proposed terms include a financial commitment of approximately R$ 170 billion, aimed at remediation, compensation, and environmental recovery. This sum encompasses R$ 38 billion already spent on immediate measures, R$ 100 billion to be paid over 20 years for public policy programs, and R$ 32 billion for performance obligations by Samarco. The settlement process, mediated by the Brazilian Federal Court of Appeals and involving public institutions, seeks to resolve all related public civil actions and provide full socio-environmental repair. Vale anticipates adding R$ 5.3 billion (US$ 956 million) to its 3Q24 liabilities for Mariana's reparation. While negotiations are still in progress and no final agreement has been reached, the settlement is subject to the finalization of terms and approvals by all parties, including Vale's Board of Directors.
