Recently, the Supervision and Evaluation Bureau of the Ministry of Finance published an article titled "Increasing the Intensity of Legal Liability and Providing Strong Legal Protection to Prevent and Suppress Accounting Violations". The Ministry of Finance stated in the article that in recent years, there has been a frequent occurrence of malicious financial fraud and other accounting violations, which seriously undermine public interests and disrupt the market economy order. One of the important influencing factors is that the illegal cost of financial fraud is too low. Therefore, the new accounting law has significantly increased the penalties and intensified the legal responsibility for financial fraud and other accounting violations. The Ministry of Finance pointed out that in recent years, domestic and foreign listed companies such as Kangde Xin, Kangmei Pharmaceutical, Luckin Coffee, Huarong, and Evergrande Real Estate have committed financial fraud, which seriously disrupted the socialist market economy order and caused significant losses to investors, attracting widespread attention from society. However, the original accounting law has obviously low punishment standards for the perpetrators of financial fraud, and the illegal cost does not significantly match the profits from fraud. For example, the maximum penalty for financial fraud companies is only 0.1 million yuan, which is difficult to form effective deterrence.
