Elon Musk and his lawyers have requested judges in California and Delaware to auction off OpenAI's shares.

According to reports, Elon Musk and his lawyers have asked judges in California and Delaware to auction OpenAI's shares, which could allow external investors to control OpenAI even if it successfully transforms. Insiders have indicated that OpenAI has no plans for an auction and that Musk and his team "want to create more chaos."

The feud between Musk and OpenAI has a long history.

In November 2024, Musk and his lawyers submitted an injunction attempting to prevent OpenAI from transforming into a for-profit organization. The injunction also sought to prevent OpenAI from engaging in anti-competitive behavior as described by Musk's lawyers.

OpenAI was founded in 2015, with founders including Musk, current CEO Sam Altman, and several other founders. Last month, OpenAI published an article on its website stating that in the summer of 2017, Musk "agreed that transitioning to for-profit was the next step in furthering OpenAI's mission."

In the fall of 2017, Musk "demanded to acquire" a "majority stake" in the company and what OpenAI referred to as "absolute control," and requested to become the CEO of the for-profit company.

In September of the same year, Musk established a public interest company named Open Artificial Intelligence Technologies.

After the company was established, OpenAI stated that it rejected Musk's conditions, "because giving him unilateral control over OpenAI and its technology would go against the mission."

A few months later, in March 2018, Musk resigned from his position as co-chair of OpenAI.

It is understood that OpenAI is the creator of the popular chat Siasun Robot&Automation ChatGPT, and the company has recently raised billions of dollars in funding, including a round of $6.6 billion, with a Company Valuation of $157 billion. Microsoft has invested about $14 billion in OpenAI.

As the head of OpenAI competitor xAI, Musk filed a lawsuit against OpenAI, claiming it "puts profit above benefiting humanity." xAI recently secured financing, reaching a valuation of $50 billion, and the company also released a standalone application for the Grok chat Siasun Robot&Automation on iOS.

Musk initially dropped the lawsuit but refiled in August of last year, arguing that the original lawsuit "lacked merit."

Musk's lawsuit recently also listed Microsoft, LinkedIn co-founder Reid Hoffman, and current Microsoft executive Dee Dempster, who previously worked at OpenAI, as co-defendants.
