According to Zhitong Finance APP, Everbright Securities (06178) announced that on December 30, 2024, the China Securities Investor Service Center Co., Ltd. (Investor Service Center) stated it has accepted a special authorization from 60 rights holders to apply to the Nanjing Intermediate People's Court in Jiangsu Province as representatives to participate in litigation. The Supreme People's Court has designated jurisdiction, and the intermediate court will handle the litigation under the special representative litigation procedure. Accordingly, the intermediate court issued a rights registration announcement on December 31, 2024, with the main content as follows:
The scope of rights holders for the litigation case includes investors who meet one of the following conditions and have the same type of litigation requests as the litigation case: (1) purchased Jin Tong Ling stocks through public bidding from April 26, 2018 (inclusive) to June 27, 2023 (inclusive) and still held them after the market closed on June 27, 2023 (inclusive); (2) purchased Jin Tong Ling stocks through public bidding from April 26, 2018 (inclusive) to April 27, 2023 (inclusive) and sold them between April 28, 2023 (inclusive) and June 27, 2023 (inclusive).
In accordance with Article 34 of the "Supreme People's Court's Provisions on Several Issues Concerning Representative Litigation in Securities Disputes," investors who meet the aforementioned criteria and fail to submit a written declaration to withdraw from the special representative litigation to the intermediate court within the stipulated time, shall be deemed to agree to participate in the special representative litigation. Investors participating in the special representative litigation are deemed to have granted special authorization to the Investor Service Center, agreeing to allow the Investor Service Center to represent them in court, to change or give up litigation requests, acknowledge the litigation requests of the opposite party, reach a settlement with the defendant, file or withdraw appeals, apply for enforcement, delegate litigation agents, etc.
Investors who meet the aforementioned criteria and do not wish to participate in the special representative litigation should submit a written declaration to withdraw from the special representative litigation to the intermediate court within 15 days after February 5, 2025. For those who declare to withdraw, the intermediate court will no longer register them as plaintiffs in the special representative litigation, and the investor may file a separate lawsuit.
