Although Tesla shareholders voted in favor of this plan at the annual meeting in June, Delaware Chancery Court Judge Kathaleen McCormick still decided to uphold the initial ruling from January, stating that the company's board of directors was too influenced by the billionaire entrepreneur when they adopted the plan in 2018.

The stock options plan was originally valued at 2.6 billion dollars and was worth about 56 billion dollars when the judge canceled the plan in January. Based on Tesla's closing price on Monday, the plan is valued at approximately 101.5 billion dollars.

Judge McCormick wrote in her opinion on Monday, "Even if a shareholder vote can produce an approval effect, it cannot do so here." The judge also granted 0.345 billion dollars in attorney fees to reward the lawyers who successfully filed the lawsuit on behalf of Tesla shareholders, rendering Musk's compensation plan invalid.

McCormick's ruling overturned the highest-ever compensation arrangement for corporate executives in the usa, which could lead to a significant reduction in Musk's wealth. However, even without this bonus, he remains the richest person in the world.

Musk can continue to appeal to the Delaware Supreme Court.
