USA special prosecutor Jack Smith had charged Trump with illegally conspiring to obstruct the 2020 election and improperly handling sensitive national security information after leaving office. On Monday, he submitted documents to the court indicating that the Department of Justice would no longer pursue these two cases against the elected president.
The special prosecutor's office attempted to dismiss Washington's charges of election obstruction against Trump. Hours later, USA District Judge Tanya Chutkan approved the motion.
Smith explained that Trump is the elected president. He stated that Trump should be exempt from prosecution based on decades-old Department of Justice legal opinions aimed at protecting sitting presidents from criminal charges.
In the case of classified records, prosecutors stated that they will not appeal to reinstate charges against Trump but will continue to challenge the dismissal of charges against his two co-defendants by a federal judge in Florida. Earlier this year, the judge ruled that Smith's appointment was unconstitutional and dismissed the case.
The usa Department of Justice's policy prohibits the prosecution of a sitting president, forcing Smith to withdraw his case against Trump after he won the election. Trump denies wrongdoing and states that if he wins a second term, he will fire Smith and direct the Department of Justice to end the special prosecutor's work.
Smith wrote that his office "fully supports" the rightness of the election interference case, but the Department of Justice's prohibition against indicting and prosecuting a sitting president is "clear." The decision to drop the case "has nothing to do with the severity of the charges, the strength of the government's evidence, or the rightness or wrongness of the prosecution."
Smith explained while questioning Judge Chutkan that, although a candidate could be criminally charged and then elected president, this kind of case is something "we have not encountered," but the conclusion reached by the department in consultation with the special prosecutor's office is that this policy "applies in this situation."
But he asked the judge to end the litigation without a prior judgment on the developments, making it possible for the litigation to be restarted at the end of Trump's presidential term.
Last year, Jack Smith formally charged Trump with four criminal counts related to his alleged attempts to overturn the 2020 presidential election results. Trump, however, pleaded not guilty.
On July 1 of this year, the usa Supreme Court ruled that Trump enjoys a certain degree of immunity from criminal prosecution in the case involving alleged "interference in the 2020 election."
After winning the presidential election in November, cases against Trump may be successively withdrawn.
Trump is the first former president in usa history to be criminally charged. He is involved in four criminal cases, totaling 91 criminal charges. Two of the four cases were brought by Jack Smith's team.
