In November 2019, Liuye signed the "Project termination settlement Agreement" with the Kaili City Transportation Bureau, and completed the clearance and exit in accordance with the requirements of the Kaili City Transportation Bureau. In August 2020, the audit of the PPP project project was completed and the approved amount was 74.6008 million yuan, but the Kaili City Transportation Bureau has not yet paid for the above project. Because the Kaili City Transportation Bureau is responsible for the PPP project under the authorization of the Kaili City people's Government and completes the settlement examination with Liuye, Liuye holds that the Kaili City people's Government, as the principal of the Kaili City Transportation Bureau, should be jointly and severally liable for the unpaid project payment.
As the project payment under the Project termination settlement Agreement has not yet been paid, Liuye recently filed a lawsuit with the Qiandongnan Miao and Dong Autonomous Prefecture Intermediate people's Court located in Qiandongnan Miao and Dong Autonomous Prefecture of Guizhou Province. the Intermediate people's Court of Qiandongnan Miao and Dong Autonomous Prefecture issued a notice of accepting the case ((2021) Qian 26, No. 71 at the beginning of the Republic of China), accepting Liuye's lawsuit request.
Liuye requires the defendant to pay 74.6008 million yuan for the project, 2.6439 million yuan for interest, and litigation costs such as case acceptance fee, appraisal fee, property preservation fee, property preservation guarantee fee and so on.
