The Ministry of Industry and Information Technology has released a public consultation on five mandatory national standards, including “Safety Requirements for Automated Driving Systems in Intelligent Connected Vehicles.” Among other provisions, the document stipulates that when ADS deactivation is complete, vehicle control must be transferred back to the driver. The deactivation of ADS should not result in the automatic shutdown of emergency assist systems, nor should it trigger the automatic activation of partial or combined driving assistance systems. During the execution of emergency collision avoidance maneuvers by the ADS—such as emergency braking or emergency steering—unless the imminent collision risk has been eliminated or the backup user actively exits the ADS—the ADS must continue to control the vehicle in order to safely mitigate the collision risk. Once the imminent collision risk has been averted, the ADS should remain operational and may not exit directly.
