On January 7, TENCENT announced on the Hong Kong Stock Exchange that the company noted the USA Department of Defense plans to release a notice regarding the designation of Chinese Military Industry enterprises on January 7, 2025 (U.S. time). According to this notice, the Deputy Secretary of Defense has included the company on the list of Chinese Military Industry enterprises.
Since the company is not a Chinese Military Industry enterprise, nor is it a Civil-military Integration enterprise of China’s defense industry, the company believes that its inclusion on the list of Chinese Military Industry enterprises is a mistake. Unlike other lists maintained by the U.S. government for implementing sanctions or export control measures, being included on the Chinese Military Industry list is only related to U.S. defense procurement matters and will not affect the group's business.
The Chinese Military Industry list is also different from the non-SDN - China Military-Industrial Complex list (NS-CMIC list) maintained by the U.S. Office of Foreign Assets Control, and being included on the Chinese Military Industry list does not prohibit anyone (except the Department of Defense) from doing business with the company, including conducting securities transactions in the company.
The company intends to initiate a review process to correct this error. During this process, the company will discuss with the U.S. Department of Defense to resolve any misunderstandings and take legal action if necessary to remove the company from the Chinese Military Industry list.
