On November 25 local time, special prosecutor Jack Smith submitted a motion to dismiss the appeal against President-elect Trump's improper handling of classified documents. In addition, Smith stated that the appeals involving two other defendants, Walter de Nauta and Carlos de Oliviera, would continue. He wrote in the document: "The appeals against the other two defendants will continue because, unlike defendant Trump, the principle of temporary immunity does not apply to them." On the same day, Jack Smith also stated that he would abandon the charges against President-elect Trump for allegedly interfering in the 2020 U.S. election and would seek to dismiss the case in court documents submitted to the judge, citing the long-standing Department of Justice stance that "a sitting president should not face criminal prosecution."
